1. Introduction

Welcome to PODCAT. By accessing or using our website, services, or tools (collectively, the "Platform"), you agree to be bound by these Terms of Service. If you do not agree with all of these terms, you are prohibited from using or accessing the Platform.

2. Description of Service

PODCAT is an online marketplace designed to connect podcast creators and hosts for the purpose of buying, selling, and swapping promotional placements (such as host reads, trailers, and feed drops). We provide the tools to facilitate these transactions but are not directly involved in the production of the podcasts.

3. Accounts and Registration

To use certain features of the Platform (such as sending swap requests or receiving payouts), you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.

4. Payments and Payouts (Stripe Connect)

Payment processing services for creators on PODCAT are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the "Stripe Services Agreement"). By agreeing to these terms or continuing to operate as a creator on PODCAT, you agree to be bound by the Stripe Services Agreement.

  • PODCAT acts as a platform to facilitate transactions. We charge a standard 10% platform fee on all paid placements unless otherwise stated.
  • Payouts to hosts for completed deals are transferred only after the buyer confirms the placement or after our standard dispute window expires.

5. Prohibited Conduct

You agree not to engage in any of the following restricted activities:

  • Using the Platform for any illegal purpose or in violation of any local, state, national, or international law.
  • Failing to deliver agreed-upon promotional placements after receiving payment.
  • Harassing, abusing, or harming another person through the Platform's messaging systems.
  • Attempting to bypass the platform fee by transacting outside of the Platform for users met through the Platform.

6. Limitation of Liability

In no event shall PODCAT, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
